Together with observations, pointing out the inconsistency and prevarication of his answer: and shewing, how the trial was eluded, and the cause struck out of the paper, just as it was going to be called on, by the positive refusal of plaintiff's counsel to open the cause, thinking it had too uncomely a countenance to appear before the court.
